I hereby certify, warrant and represent that the work I submit for exhibition and for sale at Art-A-Fair, Inc. is of my original creation. I have not violated any state or federal copyright laws, nor the privacy, ownership or other legal rights of any other person/entity in the creation of my work. Any reference materials (not limited to, but including photographs) utilized in the creation of my art are also of my own production or I have written permission from the copyright owner to use them in the creation of the work I will display at Laguna Art-A-Fair. I understand that falsification of any of the foregoing information may result in the termination of my exhibition privileges and possible permanent expulsion from the show. I take personal responsibility for any and all legal action, should it arise, resulting from misrepresentation of any of the foregoing information. For further clarification see CA Civil Code, Section 3344. I acknowledge receipt of and will abide by the Art-A-Fair, Inc. bylaws, rules for display of artwork, membership rules and regulations, ground rules, and articles of incorporation. Furthermore, I will abide by all decisions of the board of directors, which I agree are final and binding on all members. I understand that I am solely responsible for all work and/or any other property I bring to the Art-A-Fair, Inc. premises and my own safety and well-being. I hereby certify, warrant and represent that I take full financial responsibility for covering any loss and/or damage to said work and/or other property and myself. In consideration of my being accepted as a member of Art-A-Fair, Inc. and thereby being permitted to display and to sell my work, I do hereby waive all claims, release, indemnify, and hold harmless Art-A-Fair, Inc., its board of directors and all members, employees, and independent contractors of Art-A-Fair, Inc. from and against any and all loss or damage to said work and/or property and any other personal injury I may suffer. I agree to pay all booth fees on or before the date due and I agree to pay a $25.00 late fee for any booth or dues payment accepted by the Art-A-Fair, Inc. after the assigned due date. I understand that a portion of the fees I pay to the Art-A-Fair are non-refundable (minimum $200) and that in certain circumstances all fees may be forfeited. If I am expelled from the membership of Art-A-Fair, Inc. or leave Art-A-Fair, Inc. for any reason after the opening of Art- A-Fair, Inc., I will no longer be allowed to display work for exhibition or sale at Art-A-Fair, Inc., and will forfeit all monies paid. I understand that while exhibit booths are generally priced according to wall space, each space is unique and some variance in actual square footage is not unexpected. Booth measurements are approximate, as are any provided illustrations of booth spaces. Deviations, if any, are minimal. Should exhibit space be reduced or increased as a result of this natural variance and approximate measurement, booth fees will be neither reduced nor increased. I hereby release and hold harmless Art-A-Fair, Inc., its board of directors, members, employees, and independent contractors from any liability incurred in or as a result of my hiring substitute workers to perform my mandatory work duties. It is my responsibility to arrange for and to pay my substitute workers. In the event of an emergency or because of my inability to arrange for a substitute worker, I agree to allow Art-A-Fair, Inc. to hire a substitute worker for me at my expense.
